Terms & Conditions

When you become a client (“Client” or “you”) this constitutes acceptance of FitTish Training’s terms and conditions.

 

1. In order to maximise progress, it may be necessary for You to follow programme guidelines during supervised and (if applicable) unsupervised training days.

 

2. During your exercise programme, every reasonable effort will be made to ensure your safety and well-being. However prior to commencement You will be required to complete a Physical Activity Readiness Questionnaire and consent form, Client waiver and Informed Consent Form. In the event that You refuse and or fail to accurately complete and return all requested forms and information FitTish Training reserves the absolute right to cancel any planned sessions with You and to retain all monies paid by You.

 

3. All documentation, including but not limited to Physical Activity Readiness Questionnaire and consent form, Client waiver and Informed Consent Form are subject to these terms and conditions.

 

4. The Trainer will use their skills and knowledge to design a programme of exercise that will take into account your lifestyle, personal goals, fitness levels and medical history.

The Trainer will provide the coaching, supervision, advice and support that You will need to achieve your goals. Apart from the initial consultation (and the first personal training session if taken immediately afterwards) each personal training session will last approximately 50 minutes unless otherwise agreed (a “Session”).

 

5. The Trainer will provide instruction, advice, supervision and support needed within a group setting (“Class”). Each class will last around 50 minutes, unless otherwise stated.

You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the Sessions and or Classes. You acknowledge that individual results may vary and that no particular result is guaranteed by your Trainer.

 

6. You are required to arrive on time for each Session and or Class so that the Trainer’s full training plan is achieved on each visit.

 

7. You are required to wear appropriate clean clothing and footwear. When training outdoors appropriate clothing should be worn depending on the weather conditions and reflective clothes worn when dark. If You are not wearing suitable attire You may be asked to leave at the discretion of the trainer with no refund being payable by FitTish Training.

8. You shall not misuse the equipment or facilities and if You wilfully or negligently causes such damage You accept full and entire responsibility to pay in full for any damage and or losses caused.

 

9. FitTish Training accept no responsibility and or liability whatsoever for any loss, theft and or damage to any of your personal belongings including but not limited to keys, cars, mobile phones, tablets, glasses, clothing, water containers, jewellery, watches and or bank cards and or wallets.

 

10. You understand and agree that it is your sole responsibility to inform FitTish Training of any conditions or changes to your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury. If your Trainer requires further medical information from a practitioner, you must provide such details.

 

11. You should obtain professional or specialist medical advice before starting any new fitness or training regime as it is your responsibility to ensure that you are in good physical condition and are able to participate in any training activity with FitTish Training. FitTish Training is not qualified to express an opinion that You are fit to safely participate in any activity and any participation by You is undertaken at your sole risk.

 

12. You must not participate if You are under the influence of alcohol or non-prescription drugs.

 

13. If You are pregnant, post-natal or have any pre-existing medical condition (including but not limited to cardiac problems, asthma, diabetes or any mobility or muscular issues) You must not attend and or participate in any FitTish activity without first obtaining medical consent.

 

14. You may be asked to perform a number of exercises throughout your training sessions, which will be explained to You in full and where needed a demonstration given, however if You are unsure in how to engage safely then You are to immediately speak to FitTish Training. The intensity of each exercise will be guided by yourself, at a level appropriate to your ability. FitTish may halt the exercise at any time because of signs of fatigue, or You may stop when You wish because of personal reasons, fatigue and or discomfort.

 

15. There exists the possibility of certain physical and or mental changes occurring during exercise. They include (but are not limited to: abnormal blood pressure, fainting, disorder of heartbeat and in rare instances, heart attack, stroke or death). FitTish Training will take all reasonable precautions to minimise these risks by evaluation of preliminary information relating to your personal health and general fitness and by observations during your training sessions.

 

16. It is your responsibility to immediately report to FitTish Training of any occurrence of feelings of pain, discomfort, fatigue and or ill-health throughout your training sessions. Any Information You possess about your own health status or previous experiences of ill-health with physical activity may affect the safety and enjoyment of your sessions and these are to be provided to FitTish prior to any participation in any FitTish Training activity.

 

17. You are voluntarily participating in the activities and You assume all risk of injury to yourself, and You agree to fully release and discharge FitTish Training absolutely of any and all claims, losses, damages or causes of action, known or unknown, arising out of exercising with FitTish Training.

 

18. If at any time, You suffer pain or excessive discomfort, stop the activity and inform FitTish Training immediately.

 

19. Once purchased all personal training sessions, groups or classes are non-refundable and non-transferable for any reason, including but not limited to relocation, illness, and unused sessions.

 

20. The Session will be deemed to have started at the pre-arranged Session time. If the Client is late the Session and or Class will not be extended and will end at the appointed time. If the Trainer is late, additional time will be added to the Session and or Class or to subsequent Sessions and or Classes.

 

21. In case Trainer falls ill or is unable to instruct the Session, the Session will be cancelled and re-arranged but no refunds and or other losses will be accepted and or payable by FitTish.

 

22 .FitTish Training has the right to amend these Terms and Conditions. When such a change(s) is made, if dissatisfied you can cancel this agreement once you have made any payments already due to the Trainer.

 

23. Your training may be filmed or pictures taken for marketing purposes. Your participation in a Session and or Class means you consent to photography, filming and sound recording which may include You as a Client and its use in advertisement and or on social media platforms without payment and or royalty payments
